Norfolk killer denied High Court appeal

The man convicted of murdering Sydney woman Janelle Patton on Norfolk Island has been refused leave to appeal his case in the High Court.

Glenn Peter Charles McNeill is serving 24 years for the murder of Ms Patton, whose battered body was found at a picnic spot on the tiny Australian territory in 2002.

The New Zealand-born chef was jailed for at least 18 years for the crime, which sentencing judge Mark Weinberg said had shocked the Norfolk community and “sickened” Australians.

Ms Patton had 64 injuries, including a broken pelvis, ribs, a fractured skull and scores of slash and stab wounds.

Her body was wrapped in a black plastic tarp which carried McNeill’s fingerprints, and Ms Patton’s DNA was found in the boot of his car.

McNeill, 30, was convicted last March by a jury of the Norfolk Island Supreme Court and lost a subsequent Federal Court appeal.

His lawyers on Friday failed to mount a second appeal to the High Court, exhausting his final chance of having his case reviewed.

McNeill claimed that fresh evidence had come to light showing that he was not the only person who could have known the plastic tarp had come from a nearby construction site.

A book about the case which was published before the trial made “oblique reference to the sheet and its possible source” and the verdict was therefore a miscarriage of justice, he argued.

Sitting in Sydney on Friday, Justices William Gummow, Michael Kirby and Dyson Heydon rejected McNeill’s bid for leave to appeal.

He will be eligible for release in 2024.

Faith communities should recognize the Religious Left’s ‘40 Days’ campaign for what it is: a politically driven effort to expand a bloated state and make Americans evermore dependent on politicians and bureaucrats for healthcare.

Some numbers are highly significant in the Bible. The Israelites, for example, wandered in the desert for 40 years. Moses spent 40 days on Mount Sinai when he received the Law. Jesus went into the wilderness for 40 days and nights. These are periods often associated with probation, trial, or even chastisement before the Lord.

Now we have “40 Days for Health Reform,” a massive effort by the Religious Left to muster support during the congressional summer recess for the Obama administration’s nationalization of America’s healthcare system. Liberal Christians and Jews even recruited the president on August 19 for a nationwide call-in, which was said to draw 140,000 listeners. If the ministers, rabbis, and lay “community organizers” in the churches and synagogues succeed, we’ll all be wandering in the parched wilderness of socialized medicine—and for a lot longer than 40 days.

What’s remarkable about this effort is that, as Americans have started to see the details of ObamaCare, they have revolted against the plan in ever-growing numbers. They’ve shown up at town halls and given their nonplussed members of Congress a healthy dressing down. A Rasmussen Reports survey finds that most voters (54 percent) now say they would prefer that Congress simply not pass a healthcare reform package.

The Religious Left’s campaign offers little or no recognition that other key institutions—the family, the Church, local civic associations—might also have a role to play in shaping reform.

Yet the tone-deaf Religious Left has mobilized for the rescue of socialized medicine, one of its most dearly sought objectives. In doing so, its leaders have labeled the honest dissent of ordinary Americans as the fruit of “mob rule,” the result of manipulation by “right wing” talk radio hosts, and evidence of outright misinformation and falsehoods. Not a very Christian thing to do, if you ask me.

Jim Wallis of Sojourners, who worked so feverishly for Obama’s election, has been leading the charge. He recently wrote that the “storm troopers of political demagoguery, such as Rush Limbaugh, Sean Hannity, and Glenn Beck, have mobilized their followers to disrupt town meetings and defeat comprehensive reform by yelling louder than anybody else.” Like others, Wallis has cast the healthcare debate as a Manichaean battle between the forces of Light and Darkness, prooftexting the president’s and the Democratic congressional reform plan with handy bits of Holy Writ.

In the Washington Post, he cited Leviticus to show that the Bible lays out a “detailed public health policy in regards to contagious rashes and leprosy.” This, Wallis claimed, proves that “the laws governing the Hebrews ensured that participation in their healthcare system was not based upon economic status in the community.” I must have missed that lesson in seminary.

We get the constant demand from the Religious Left that Washington must act. It is a sort of idolatry—the worship of Big Government as the solution to all of our problems.

Amazingly, Wallis told Congressional Quarterly that opponents of socialized medicine “really want to shut down democracy and we can’t let that happen. The faith community is literally going to stand in the way of those who want to stop a conversation.” CQ also quoted John Hay Jr., an evangelical leader from Indianapolis, Indiana, who said that “40 Days for Health Reform” is “really an effort to refocus where the central moral issue is—it seems to have been derailed or taken off track by a lot of voices over the past couple of weeks.”

Along with Sojourners, some of the key collaborators on the Religious Left’s rally to the White House and congressional plan include PICO National Network, Faith in Public Life, Faithful America, and Catholics in Alliance for the Common Good.

The U.S. Conference of Catholic Bishops has argued that healthcare is a human right that should be available to all. “The Bishops’ Conference believes healthcare reform should be truly universal and it should be genuinely affordable,” wrote Bishop William F. Murphy, the chairman of the USCCB’s Committee on Domestic Justice and Human Development, in a July 17 letter to Congress. Now, Catholics can agree or disagree with the bishops’ advocacy for universal healthcare—that’s a question of prudence not dogma. Tellingly, Bishop Murphy’s letter did not cite Scripture, the catechism, or any papal encyclical. It was argued from a basis in policy and motivated by the bishop’s honest desire for improvement in a system where one in six patients in the United States is cared for in Catholic hospitals.

But note also what the Catholic bishops did. They issued a clear and forceful call for a reformed health policy that “protects and respects the life and dignity of all people from conception until natural death.” That non-negotiable insistence on the respect for life is, by and large, missing from the Religious Left’s campaign. What we get instead are bland assurances, parroted from White House and congressional talking point memos, that “life and dignity” would be forever safe under ObamaCare. I am not persuaded.

What else is missing from the Religious Left’s campaign? Plenty.

There is no acknowledgement that expanding federal spending by $1 trillion or more to reengineer the American healthcare system, and further burdening future generations with groaning debt loads, might be a bad thing. Or would the Religious Left simply have the government declare a Jubilee and disavow these debts when they become totally unmanageable? Is this too somewhere in Leviticus or perhaps Deuteronomy?

There is little or no recognition that other key institutions—the family, the Church, local civic associations—might also have a role to play in shaping reform. Certainly, no recognition for those civic and social groups that have a healthy distrust of an invasive state. Instead, we get the constant demand from the Religious Left that Washington must act. It is a sort of idolatry—the worship of Big Government as the solution to all of our problems.

There is a near total blindness to the fact that nationalized health systems in other countries are deeply troubled, even deadly. Horror stories about these systems are plentiful in the mainstream media. What about the common good? A 2002 report by the Adam Smith Institute noted the following about Britain’s state-run healthcare monopoly:

The NHS has a severe shortage of capacity, directly costing the lives of tens of thousands of patients a year. We have fewer doctors per head of population than any European country apart from Albania. We import nurses and doctors from the world’s poorest countries, and export sick people to some of the richest. More than one million people—one in sixty of the population—are waiting for treatment.

Faith communities should recognize the Religious Left’s “40 Days” campaign for what it is: a politically driven “community organizing” effort that aims to expand a bloated state and make Americans evermore dependent on politicians and bureaucrats, not doctors, for healthcare. As people of faith, we need to speak up against this dishonest affair. After all, it’s our “prophetic” duty.

Maybe the flight attendants should start talking to the cockpit, too. When a plane overshot Minneapolis last month because the crew was playing around with personal laptops, national attention turned to what actually goes on in the front of the plane. Congress is kicking around the idea of a new bill that would kick personal electronic devices from the cockpit.

Unsurprisingly, the pilots and airlines aren’t crazy about the idea. They say that the measure would impede progress by making innovation less accessible. Scott Schleiffer, a cargo pilot who’s also thrown some brain time at safety issues for the Air Line Pilots Association, told USA Today, “We would like to have access to tools, and as tools evolve, we would like to have better tools.”

FAA chief Randy Babbit agrees, saying, “We need to be very careful,” in regards to the prohibition of personal devices in the cockpit.

Airlines are starting to bring new technology into the cockpit, with laptops and other devices used to improved weather and safety information. The devices aren’t all that different from what distracted the Northwest pilots who missed Minneapolis. JetBlue has issued laptops to pilots, which are used to push through calculations during takeoff and landing. But, the airline doesn’t allow personal use of them.

So far, two bills have been introduced in the Senate. They would exempt devices used to operate the plane or help with safety issues, but pilots don’t believe that this is enough.

Neither side of the argument addresses the core problem: keeping pilots focused on the job. In theory, extraordinary measures shouldn’t be necessary. Professionals, by definition, should not need that kind of intense oversight. It’s already against the against the law for pilots not to pay attention to their responsibilities, and that’s probably enough regulation. Instead, the solution needs to come to the airlines — organizational measures are needed to ensure that professionals remain professional. Executed properly, the good ones shouldn’t even notice a different.

Profiteering government must put plans in place to stem misery of UK motorists

The government failed the UK public because it sat back and raked in cash from record oil prices without putting plans in place to help the plight of millions of motorists.

That鈥檚 the view of a leading online motoring organisation which is called on the government to act quickly and decisively to draw up plans to pump some of its petrol windfall back into the transport infrastructure.

www.mammothcars.com estimates that the government was earning an extra 拢2bn per year on VAT alone compared with this time last year 鈥?from rising petrol prices. But it seems content to sit on the extra cash without devising any sort of plan about how the money could be invested back into the economy to improve the UK鈥檚 road, rail and air network.

The company鈥檚 marketing director Jon Kirk accused the government of double standards because he believes that if such a windfall related to either health or education, ministers would be quicker than greased lightening to get on TV and announce how they intended to spend the money.

“Once again transport is the poor relation when it comes to government policy because it has very clear ideas on how to spend record amounts of taxpayers鈥?money on health and education but it doesn鈥檛 have a clue when it comes to transport,” he said.

“The government is making extra cash hand over fist from rising fuel prices as petrol prices reached 拢1.20 a litre but it is failing in its responsibility to set out a vision for how that money can be used to make significant improvements which will benefit users of cars, bikes, trains and planes.

“It feels like motorists are the cash cow of the UK economy because drivers have to buy fuel and pay tax on their cars and the money they are forking out for both is rising dramatically and they have nothing to show for it as a result.”

Kirk points to the fact that the government is currently spending approximately 拢20bn per year on transport and at current rates it is raising 拢9bn from VAT alone. It also collects duty which is approximately three times the amount of VAT on a litre of petrol. This means the government is currently raising an estimated 拢35bn from sales of petrol and diesel alone.

“This is an astronomical amount of money in itself and doesn鈥檛 take into account new car tax increases or Vehicle Excise Duty 鈥?which is about to go through the roof because of increases that will double in some instances and 43% of motorists will be worse off,” said Kirk.

“And all this revenue is being generated by hitting the pockets of motorists but the government doesn鈥檛 appear to be giving anything back; either directly to ease the financial burden or by setting out a vision to invest the extra money wisely so it will benefit everyone.

“At every turn the government says that increases are to help the environment but there seems to be little evidence that the money is being used for that either.”

Free Running – Jump Britain… Monkey Men or Graceful Acrobats?

Jump Britain…

Dumb boys acting like monkeys jumping around could be one point of view taken from this new outdoor activity ‘Free Running’ recently broadcast by channel four. I prefer to take the opinion of graceful street acrobat, performing incredulous feats of the physical only possible by control of the mental.

In this programme the athletes (the respectable title they deserve) perform acts that can only be described my mind over matter, heart stopping stunts such as jumping over the gap in the roof of the millennium stadium, a 150ft drop, no ropes, no safety, nothing to rest the mind from those ‘what if’s’ we human too often struggle with.

This activity rewinds back to more primitive times, the way in which the free runners leap over objects with very little sense of danger is reminiscent of the way monkeys and tarzan leap from vine to vine through the jungle. It is an instinct not necessarily understood in logical or practical means but it is the same instinct that possesses a child to climb a tree and jump off the highest branch possible or see how many stairs they can jump down to the bottom.

As the programme goes on it becomes almost impossible to blink as the performers take risk after risk, scaling multi-storey car parks, bridges, roof tops, castles and skyscrapers. The adrenaline is palatable even from the safe comfort of the living room. It doesn’t take long to realise this sport could be loved by a lot of people, those people that stand at the train station wondering if they could jump from the platform to the other side of the tracks.

The only negative factor of this programme was the obvious lack of women participating in free running, as in too many extreme sports it’s as if the pursuit of freedom through risk taking is tightly restricted to the Y chromosome.

The truth about free running is that anybody can do it. It isn’t like surfing where it takes months of practice to be able to even stand up on the thing, anyone can jump from one object to another, it just takes a bit of mental practice (and maybe pumping a bit of iron at the gym) when it comes to the more riskier stunts.

There will no doubt be a massive political correctness backlash with tons of stupid kids jumping off buildings with no prior practise or training, but this is true of every extreme sport which has come out of the underground in the past 15 years. Eventually it will make its way into the acceptable mainstream, only in a matter of lawsuits and years.

There is more good news for coffee drinkers.

Two studies have shown that drinking coffee can reduce your risk of stroke and may also reduce the chance you are hospitalized for heart rhythm problems.

Each year more and more studies show the benefits of drinking coffee. In addition to improved brain function and alertness, it appears coffee may also help reduce the risk of two of the leading killers in our society: stroke and heart problems.

A study by Kaiser Permanent in Oakland, California shows that people who drink at least 4 cups of coffee a day have an 18 percent less chance of being hospitalized for irregular heart beat.

A study by the University of Cambridge in England shows benefits for those at risk of stroke.

This study released in February 2010, a few weeks before the heartbeat study, showed that people who drank coffee had a 27 percent less risk of having a stroke than those who didn’t drink coffee.

The study did not show that it actually matters whether someone drinks one cup of coffee a day or four or more, the benefits appear to be the same.

The University of Cambridge study took a look at a large group of people based on information they provided about their coffee intake.

It evaluated 23,000 people for 12 years based on information they provided about their coffee drinking, said researcher Yangmei Li, an epidemiologist at the University of Cambridge in England.

The study’s findings were presented in San Antonio at the American Stroke Association’s annual conference in February.

Interestingly the risk stayed the same regardless of what type of coffee people drank, even if it was decaffeinated. In addition, instant and ground coffee had the same effect.

A spokesman for the American Stroke Association said this study reflects others which have shown that coffee has health benefits. Several previous studies have pointed in this direction as well, showing the benefits of coffee consumption.

One reason that it might lower the risk of strokes is that drinking coffee is believed to help reduce the risk of getting Type 2 diabetes, which can lead to strokes and also believed to lower the chances of heart disease.

Previous studies, including one published in Circulation: Journal of the American Heart Association in 2009, show that drinking at least two cups of coffee day leads to a lower stroke risk in nonsmoking women.

The 24-year study, which used Nurses’ Health Study data, showed that women nonsmokers who drank four of more cups of coffee a day had a 20 percent less chance of having a stroke. Women who drank two to three cups a day had a 19 percent less chance and women who drank coffee five to seven times a week had a 12 percent less chance.

What is interesting about this study was that other beverages with caffeine in them, as well as decaffeinated coffee, did not appear to lower the risk the way caffeinated coffee did.

One theory is that the antioxidants in caffeinated coffee reduce inflammation and improve blood vessel function.
